1. Acceptance of Terms
KickAbout is a product of Pull Kitt Enterprises LLC, a limited liability company registered in Illinois. By creating an account and using KickAbout you agree to these Terms and Conditions in full with Pull Kitt Enterprises LLC. If you do not agree you must not use this app.
2. Eligibility — 18 and Older Only
KickAbout is available only to users who are 18 years of age or older. By creating an account you represent and warrant that you are 18 or older. Users under 18 are not permitted to use the app under any circumstances.
3. Nature of the Platform
KickAbout is a digital platform that allows users to organize and discover informal pickup sports games. KickAbout does not organize, supervise, sponsor, or participate in any game, match, or physical activity posted on the platform. KickAbout is solely a communication and coordination tool.
4. ASSUMPTION OF RISK
**__BY USING KICKABOUT YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH PARTICIPATION IN ATHLETIC ACTIVITIES INCLUDING BUT NOT LIMITED TO INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, AND ALL OTHER HAZARDS ARISING FROM PARTICIPATION IN SPORTS AND RECREATIONAL ACTIVITIES. THIS ASSUMPTION OF RISK APPLIES TO ALL ACTIVITIES FACILITATED THROUGH THE KICKABOUT PLATFORM.__** You confirm you are physically fit and capable of participating in the activities you sign up for, and you agree to assume these risks each time you join or host a game.
5. EXCULPATORY CLAUSE — LIMITATION OF LIABILITY
**TO THE MAXIMUM EXTENT PERMITTED BY LAW KICKABOUT SHALL NOT BE LIABLE FOR ANY INJURIES, LOSSES, DAMAGES, OR CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM. THIS LIMITATION APPLIES TO ORDINARY NEGLIGENCE BUT DOES NOT APPLY TO GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.**
6. Host Vetting Disclaimer
**KICKABOUT DOES NOT VET, SCREEN, BACKGROUND CHECK, OR ENDORSE ANY HOST ON THE PLATFORM. KICKABOUT MAKES NO REPRESENTATIONS ABOUT THE SAFETY, QUALIFICATIONS, OR SUITABILITY OF ANY HOST. USERS PARTICIPATE AT THEIR OWN RISK.**
7. Venue Disclaimer
KickAbout does not verify, reserve, or guarantee venue availability, safety, or suitability. The host is solely responsible for ensuring the playing space is safe, reserved if required, and legally available for the scheduled game.
8. User Conduct
Users of KickAbout agree to treat all other users with respect and dignity. You agree not to harass, threaten, or discriminate against any other user on the basis of race, gender, religion, nationality, sexual orientation, disability, or any other characteristic. Hosts are responsible for maintaining a safe and respectful environment at their games. KickAbout reserves the right to remove any user from the platform who violates these standards without notice or refund.
9. Host Responsibility
Users who host games through KickAbout are solely responsible for the safety, organization, and conduct of their games. KickAbout bears no responsibility for the actions or omissions of any host or participant.
10. Indemnification
**You agree to indemnify, defend, and hold harmless KickAbout, its founders, employees, contractors, and affiliates from and against any and all claims, demands, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your participation in any game; (c) injuries to yourself or to others caused by your conduct; (d) any property damage; or (e) your violation of these Terms or applicable law.**
11. Host Feedback Mechanism
KickAbout provides a host feedback mechanism allowing players to submit ratings and written feedback about hosts after each game. Feedback is reviewed by KickAbout administrators only and is not shared publicly or with the host. KickAbout reserves the right to remove hosts based on feedback but does not guarantee any specific action will be taken and is under no obligation to act on any individual report.
12. Photo and Video Policy
KickAbout does not collect, store, or display photos or videos of users on the platform. Users are prohibited from sharing photos or videos of other participants through the platform without the explicit consent of every identifiable person.
13. Account Termination
KickAbout reserves the right to suspend or permanently terminate any user account at any time and for any reason including but not limited to violation of these Terms and Conditions, reports of misconduct from other users, or behavior deemed harmful to the KickAbout community. Users may also delete their own account at any time from the Profile tab. KickAbout is not obligated to provide a reason for account termination and no refund of subscription fees will be issued for terminated accounts.
14. Cancellation, No-Shows, and Suspensions
Players who fail to attend a game they confirmed for incur a 1-point reliability penalty per no-show. After 3 no-show warnings an account may be temporarily suspended; after 5 no-shows the account may be permanently banned. Hosts who repeatedly cancel games or fail to close them on time may have hosting privileges restricted.
15. Host Transfers
A host may transfer hosting duties to a confirmed participant. The nominated player has 24 hours to accept. If they decline or do not respond in time, the game is automatically cancelled and all confirmed players are notified.
16. Auto-Close Rules
Hosts have 72 hours after the scheduled end of a game to mark attendance and close the game. If the host does not close in time, KickAbout auto-closes the game and applies a default 3-star host rating from any unrated participants. Repeated auto-closes may reduce a host's standing.
17. KickAbout+ Premium Membership
KickAbout+ is an optional premium membership that unlocks ad-free browsing, unlimited hosting beyond the free monthly cap, saved locations (up to 5), a priority tiebreaker in the public standings, and priority waitlist promotion. Membership confers no additional ownership or governance rights and may be revoked for violations of these Terms.
18. Geo-Awareness
KickAbout is focused on Chicago and the surrounding metropolitan area. Games posted outside of Chicagoland are allowed but may have limited visibility in the feed and reduced friend-discovery features.
19. Rate Limiting and Abuse Prevention
KickAbout enforces server-side rate limits on actions such as notifications, SMS delivery, invite-code lookups, and other sensitive endpoints. Attempting to bypass these limits, scripting the API, or otherwise abusing the platform may result in immediate account suspension or permanent ban without refund.
20. MANDATORY ARBITRATION AND CLASS ACTION WAIVER
**ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF KICKABOUT SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION WITH PULL KITT ENTERPRISES LLC, ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN COOK COUNTY, ILLINOIS UNDER ITS CONSUMER ARBITRATION RULES. YOU AND PULL KITT ENTERPRISES LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.** **30-DAY OPT-OUT:** You may opt out of this arbitration agreement by mailing a written notice to Pull Kitt Enterprises LLC, Chicago, IL, or by emailing hello@joinkickabout.app, within 30 days of first creating your KickAbout account, stating clearly that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
21. Governing Law and Notices
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Except for matters compelled to arbitration, any disputes arising under these terms shall be resolved in the state or federal courts located in Cook County, Illinois. Formal legal notices must be sent to Pull Kitt Enterprises LLC, Chicago, IL.
21a. Gender Self-Reporting for Intramural Games
Some games are marked as intramural fill-ins, where a host needs a specific gender breakdown to satisfy league or team requirements. Gender on KickAbout is self-reported by users in their profile. KickAbout does not verify gender and makes no representations about the accuracy of self-reported gender data. Hosts of intramural games are solely responsible for verifying gender eligibility for their league. KickAbout is not liable for disputes, league penalties, forfeits, or any other consequences arising from gender misrepresentation by any user.
22. Changes to Terms
KickAbout reserves the right to update these terms at any time. Continued use of the app after changes are posted constitutes acceptance of the new terms.
